Terms of use

These terms apply to the use of the ActifZ Lead service, published by ACTIFZ REALITY SARL, by real estate professionals who open an account (“the client”) and by the people they allow to use it (“the users”).

1. The service
ActifZ Lead is online software that receives the messages sent to the client’s WhatsApp Business number, answers them through an automatic assistant (Zenith) or one of the client’s salespeople, qualifies enquiries, schedules visits and passes leads to the client’s management system. The service is provided as is; ACTIFZ REALITY SARL undertakes to run it with care, without guaranteeing that it is free of interruptions.
2. The account
The client creates accounts for its staff and remains responsible for what they do in the service. Each user keeps their password to themselves. The client informs ACTIFZ REALITY SARL without delay if it believes an access has been compromised.
3. The WhatsApp number and Meta’s rules
The client connects its own WhatsApp Business number, which it holds. It undertakes to follow the terms of Meta’s WhatsApp Business Platform: messages sent only to people who gave their consent, message templates submitted to WhatsApp for approval, no content prohibited by Meta. ActifZ Lead may suspend a sending that would break these rules.
4. Leads’ data
The client is responsible for the leads’ data it processes in ActifZ Lead. ACTIFZ REALITY SARL processes it on the client’s behalf and on its instructions, as described in the privacy policy. The client informs its leads of this processing and answers their access or deletion requests; ACTIFZ REALITY SARL helps it do so.
5. The automatic assistant
Zenith answers from the information the client entered about its projects. The client reviews and completes this information and can take over any conversation. Zenith makes no contractual commitment on behalf of the client: a price, an availability or a promise is confirmed by the client.
6. Prices and credits
The service is billed according to the plan chosen by the client and the message credits used, at the prices shown in the “Usage and billing” screen. Prices may change with one month’s notice.
7. Term and termination
The client may close its account at any time. ACTIFZ REALITY SARL may suspend an account in case of a serious breach of these terms or of Meta’s rules, after notifying the client. On closure, the client’s data is deleted within 30 days, unless the law requires keeping it.
8. Liability
The liability of ACTIFZ REALITY SARL is limited to the amounts paid by the client over the last twelve months. ACTIFZ REALITY SARL is not liable for an interruption of the WhatsApp platform, nor for business decisions the client makes from the information in the service.
9. Governing law
These terms are governed by Moroccan law. Any dispute is brought before the competent courts of Casablanca, after an attempt at amicable settlement.
